Does the Diplomatic Clause reset every supplementary lease extension? Scenario: we have been in the same property since 2018. The usual DC conditions were set in the first TA (2 months notice after 12 months). Since then we have signed 3 individual supplementary agreements with no specific mention of the DC, the assumption being that the 12 month lock in was covered in the first TA and since then we have been able to give the required 2 months DC notice (if required). The LL has just presented the 4th supplementary (12 month extension) but has now explicitly struck through the DC conditions. They are arguing the DC does not apply as the lease is 12 months. Help please.

This is a private agreement between the landlord and tenant. There is no standard to be applied in such cases. As long as both are agreeable to terms, then it can be done. I have done diplomatic clause tenancy for 12 months lease too. Read More

    Hi Paul,

    Nothing is fixed, it is down to both landlord and tenant agreement to the clause itself, so this is something you need to negotiate with the owner. If terms and conditions cannot be agreed, the only option is to leave for a new place, but that said, you will also face the same situation of diplomatic clause with new landlord.

    Thanks, Geryl. So with a 12 month rental lease what would the structure of a diplomatic clause look like? If a 12 month break clause is for a 24 month lease is normal then would a 6 month break clause (2 months notice thereafter) be reasonable for a 12 month lease?

    There is also the separate consideration that we have been in the same property now for six years, extending with a supplementary agreement each time, and consider our DC 12 month break clause 'served' many years ago.

Really subject to both parties agreement , but in my opinion, i feel more for tenant in this case , reason being for landlord>> there is NO SUCH CASE LIKE EXAMPLE: 2 to 4 months of rental lost because tenant is changed for the past years,... use your skills to negotiate and try to fight for your interest based on reasonableness ( u can mention my point to landlord too ) ! just try ,,, who knows ?
