Hi guru

My wife's late sister was sole owner of hdb flat. Beneficiaries are 3 siblings, namely my wife, her sister, and her brother. It should be under Intestate Succession Act. Buy presently her brother is staying in that flat, refusing to move out, refusing to sell, not cooperating to get lawyer, not applying for Letter of Adminitration. The sole owner has passed away 9 months ago. Wandering what will happen after 12 months, will govt force sell the flat, will hdb force to buy back? If so, wandering what kind of price will hdb pay them? Pls advise. Thanks.

Hi FN,

1) First thing is to apply for a Letter of Administration so as the HDB can be legally distributed accordingly. You don't need everyone to do this.
2) If you are unsure how to do this, you may approach the HDB branch office to enquire, They should be able to assist.
3) No government body will step in if that is your worry.
4) You may sell back to the HDB, but note that the amount offer by the HDB is at least 20% lower than the market rate. You may request how much the HDB will offer before you make a decision whether wanted to sell in the open market.
