If tenant break contact do we have the rights not to return the deposit? Though we had find new tenants to take over but is causing us inconvenience as we need to recontact another year and we had intention to sell the house.

Hi,
If you were able to find new tenants to takeover, a portion of the deposit can be retained for time and effort, and the balance should be returned to the tenant. If this matter is not settled amicably, the tenant can also go the Small Claims Tribunal to claim his fair share of the deposit. So, better to save the hassle and trouble.
