Propnex agent backing off deal. Seller agent asked for xxx k, which I agreed to it. Drafted out option form which I verified okay. Now tell me owner ask more than xxx k.

Can advice how to complain, thanks. Clever agent, didn't send me the signed option form.

Hi,

I can understand your frustration. But I do not think you should put the blame on the Seller's Agent. In my opinion, it is the Seller that backs out from the deal, not the Agent. I believe he's motivated to close the deal too. As long as the OTP is not signed and issued (or the Buyer's consideration banked in), the Seller has the right to back out from the verbally agreed price.

Perhaps the situation can be better handled if you had engaged an agent to act for your interest? You might wish to consider this option for your future purchase to avoid potential hiccups and pitfalls.

Hi,

1) I'm not speaking on behalf of the seller's agent.
2) Shifting of goal pole on the seller is rather common. Seller does change their mind when an offer is presented.
3) The agreed price between yourself and the seller's agent is a price that the agent thought the seller will accept.
4) An OTP without the seller's signature is useless, it is just a piece of paper without any legal effect.
5) You may request the seller's agent to return your cheque and rest the case.
