Tenant breaking lease early
Hi I have just sign a 1 year lease with the tenant and 1 month into the lease the tenant informs that he wants to end lease early.
A agent helps him to find me a tenant.
However I am required to pay the agent the full commission.
1) can I get my pro-rated agent fee back.
2) Can I forfeit the tenant security deposit
3) Do I need to pay full commission to the agent that helps him to get a replacement
What is he liable by breaking lease?

Hi,

Yes in your case, beside forfeiting of the security deposit, the tenant will also need to pay you back a pro rated agent commission for the remaining 11 months left on the TA.

    The tenant indicated that there is no clause in the TA that says to forfeit his deposit when tenancy is broken. What is this due performance and observance means. He wants to file a claim against the landlord. Do I have my rights to maintain my position?
