Dear Experts,

Need your advise on this particular. While doing contra for a buying and selling of HDB. After exercising the option to purchase, can seller keep delaying on the submission of the application without proper explanation? Furthermore, there is not replies from them on whether when they will do the submission.

Typically before entering into Option To Purchase, the timeline for submission should be discussed and have it reflected in the OTP. Have you checked your OTP? Do you have an agent and also does seller have agent?

    Yes. The OTP states 75 days submission. But I'm just wondering if they could delay the submission (but still within the 75 days) when we have exercised the option without any proper explanation. And whenever asked it's always " will submit these few days"
Hi, firstly the seller can’t even keep delaying on the submission as the timing on the submission dateline will be reflected in the OTP.

Hi,

1) It seems that you didn't understand the figures that filled in the blanks.
2) I can't remember how many times I had highlighted that DIY buyers have to read carefully the important notes on the option to purchase provided by every OTP.
3) You need to know and understand the implication before handing over your money.
4) Now it is 75 days to submit your resale application. It means that you had agreed only to submit your resale application later, up to a latest of ~2.5 months (75 days) from the date of exercising.
5) So the seller did not delay the submission. It is you who did not understand what you had agreed to and entered into a legal agreement.

The submission period should be discussed and fixed before both parties enter into an OTP. By doing so, there is no reason for either parties to delay the submission beyond the stipulated period.
