Early termination. We have two year lease contract, but due to the need of bigger space we asked Agent for early termination, they agreed and we provided the date of our last stay. Understood that we will not be getting any from the deposit, but we assisted also on viewings and agent didn't come. Now agent visited and saying, we cannot terminate the contract unless new tenant comes in, and even if we move out we still need to pay rent until new tenant comes in.
TA says 'If the Tenant is in breach of any clause and /or terminates this tenancy prematurely, then the Tenant shall reimburse the Landlord commission paid to the Agency on a pro-rata basis for the remaining unfulfilled term. The Landlord has the right to deduct such reimbursement of the commission from the security deposit as stipulated by Clause 2 above. The Landlord is also entitled to compensation for losses incurred as a result of the early termination'... can you advise and confirm if we really cannot use this clause for early termination? And that we can move out without us being charged of any rent after moving out? Appreciate the advise.
