When a buyer has put down a deposit for a unit that has a "sale with tenancy", can the buyer requests for the agent to change the OTP to have the seller terminate prematurely ?

There is no premature termination clause for the landlord but there is a premature termination clause for the tenant. How can the buyer take over the vacant unit when such unit has such a tenancy agreement ?

Hi,

1) If the property is advertised as a sell with tenancy meaning the seller/owner is going to pass the tenancy contract over to the buyer.
2) Should the buyer wants to terminate the tenancy contract, it is up to the buyer's own discretion on how to settle it.
3) If you are buying for your own stay, it is best to avoid such listing as the following up could be difficult and nasty in the whole process.
4) You should either look for those stated that "sell with vacant" or speak to the agent to understand whether there is any tenancy contract to avoid trouble after buying.

When the Buyer is willing to put down a deposit to purchase the property, the Buyer should be ready to accept that the property is selling with existing tenancy. The rights of the Landlord will be transferred to the Buyer upon the completion.

If the Buyer wish to terminate the tenancy after the legal completion, he may wish to speak to the Tenant on this matter to see if a consensus can be reached.
