For hdb whole flat rental, we have been doing for the past years and no problem. We are overseas and don’t have time to check on the tenant every month. Question is what if there’s squatters with illegal immigrant overstay status ? If some neighbors reported and caught, would landlord be responsible? Thanks

By the way, it is up to HDB to penalise the owner if the tenants are caught flouting HDB ruling. But if it is proven that the owner does not know or is aware of such doing by the tenant, they will be let off by the HDB. I have such a case of flouting of HDB ruling before and my landlord was called up by HDB for an interview but he was ok and let off as we are totally unaware that the tenant sublet the flat out to many workers behind our back.

Hi,
Yes, LL will be held accountable. Ideally, you should appoint an agent to handle this for you. I do this service for my overseas clients. I also arrange change of tenants, paint, touch up and clean the premises so that the unit gets the highest rentals all the time.

The owner of the unit would ultimately be responsible for the unit and the occupants inside. However usually when there are illegal subletting, HDB will do a spot check and report the findings to the owner and allow the owner to rectify the situation. If the owner repeatedly ignore the warnings from HDB then HDB may repossess the unit.
