I can understand your fustration for not being to sell your property.

To answer to your questions;

You do not need to pay your Agent anything unless you have mutually agreed on other things besides the Standard Com. Before you look for another Agent, you need to make sure that you have receive a letter from the Agent's company stating that the Exclusive Right has been expired and you are discharge from the Contract. If you did not receive the letter and you no longer wish to use the service, you should write a letter to the Agent's company to Terminate your Exclusive Right giving reasons for terminating the service.

There are lots of factors that influence the Selling of the property. I would suggest that you sit down with the Agent and ask him/her what're the contraints that he/she facing selling your property before deciding on the Termination.

In my opinon, Selling with Tenancy is usually the main factor that hold back the Sale of the property with Today's market condition.
