Hi, I am told by an agent to give a cheque to the seller as an offer. The cheque amoount is 1% of the offer price. My question is, what if the seller banks in the cheque and 2 weeks later decide not to sell the condo to me. Then he says he has spent the money and will need 12 months installment to pay me back. What recourse do I have? What is there to protect buyers like us from falling into such scams?

A prudent and diligent agent will always have an ownership search done. If the deal seems too good, then more caution like bankruptcy search, meeting with spouse, family members, photos etc. Legal claim will be the ultimate decision. www.catherinepang.com Read More

In Singapore, the property buying process is designed to protect both buyers and sellers, but it's important to follow the proper procedures to safeguard your interests. Here’s a detailed explanation of the correct process and what recourse you have if things go wrong:

### Proper Procedure for Making an Offer:

1. **Option to Purchase (OTP):**
- The standard procedure involves the buyer issuing a cheque for 1% of the offer price as an option fee, but this should only be done in exchange for the Option to Purchase (OTP) document. The OTP is a legal document that gives the buyer the exclusive right to purchase the property within a specified time frame (usually 14 days).

2. **Exercise of Option:**
- If you decide to proceed with the purchase, you exercise the option by paying an additional 4% (or other agreed amount) of the purchase price to the seller within the option period. This makes up the total 5% down payment.

### Recourse and Protection:

1. **Legal Binding Document:**
- The OTP is a legally binding document. Once the seller issues the OTP and you pay the 1% option fee, the seller is legally obligated to sell the property to you if you exercise the option within the agreed period.

2. **Trust Account:**
- It is advisable to have the cheque for the 1% option fee made payable to the seller's solicitor or held in a neutral party’s trust account. This ensures that the funds are secure and only released according to the terms of the OTP.

3. **Consequences of Seller Backing Out:**
- If the seller backs out after issuing the OTP and taking the option fee, they are in breach of the agreement. You can take legal action to either:
- Enforce the sale of the property.
- Seek damages for the breach.

4. **Seeking Legal Advice:**
- If a seller refuses to complete the sale or misappropriates the option fee, you should seek immediate legal advice. A lawyer can help you understand your rights and the best course of action.

5. **Reporting to Authorities:**
- In cases where you suspect fraud or misappropriation, you can report the matter to the Council for Estate Agencies (CEA) if it involves an estate agent or agency, or to the police if it's a criminal matter.

### Best Practices to Avoid Scams:

1. **Use Reputable Agents:**
- Always engage reputable and registered property agents. Check their credentials with the Council for Estate Agencies (CEA).

2. **Document Everything:**
- Ensure all agreements, especially the OTP, are properly documented and signed.

3. **Hold Funds Securely:**
- Use a solicitor’s trust account to handle large sums of money.

4. **Verify Information:**
- Verify the ownership and legal status of the property with the Singapore Land Authority (SLA).

5. **Seek Legal Assistance:**
- Before making any large financial commitments, consult a lawyer to ensure all documents and processes are in order.

### Conclusion:

To protect yourself when making an offer on a property, always follow the correct procedures, including obtaining and securing an Option to Purchase (OTP) document. Ensure funds are handled securely through trust accounts and seek legal advice if any issues arise. These steps will provide legal recourse and protect you from potential scams.
