Hi,

I need some advice. My agent has collected a 1% cheque from a potential Buyer A. I did not sign any documents at all & did not bank in the cheque. Can I still sell my property to Buyer B by accepting & banking in his cheque?

In this case, I understand that there is no contract between me (seller) and Buyer A as long as I return his cheque to him? Is that right?

Afternoon Sarah,

Your agent should be able to advice you accordingly. I'm not sure what arrangement you had with your salesperson, before the start of the sales, like Power of Attorney, Exclusive, etc.
All I can say if Option have being issued, you will have to abide by the rules.

Hi Sarah, agent collecting cheque to test owner's resolve in selling his/her property is v common. As long as no OTP is signed, you have the right to take up offer from another buyer.
