I am a singapore PR and I own a 5I HDB flat jointly with my wife. I am the sole contributor for the house at the time of buying and also for loan repayments from my CPF.
I intend to sell the house now but my wife is not willing to sell and she is refusing to sign the document. is there any way I can sell this house without she signing the document.

What if I surrender my PR..what happens to the house then?

Evening,

As you purchase the unit under joint ownership with your wife, she will have to sign on the OTP, for the sales to take place.
I trust that you have purchse the unit with your wife, who is also PR. If one of you loses the PR, the HDB would likely to take back the unit.

Hi Ramesh,

There is no way you can sell the house without your wife's consent! It does not matter whether she is a joint owner or just an occupier. Even if her name is not in the house at all, you still need her consent.

If your wife is an owner, she needs to sign on the Option To Purchase. Even if she's not, she will need to sign on the Spousal Consent Form to sell the HDB property.

If you surrender your PR, then both of you will not be eligible to hold on to the flat anymore. There are a few outcomes to the situation depending on whether have you fulfilled the Minimm Occupation Period of the flat.
