I am thinking of selling my Private Condo unit to a buyer who agrees to lease back to me the unit for a further 6 months after the sale completion and an agreed monthly rental. How can I ensure that the buyer would hold his promise or agreement ? Is it advisable for us to do a separete tenancy agreement or it is advisable for me to ask for this clause to be included in the Option to purchase ?

Afternoon,

For resale of private property, you can include the TA, as a deciding factor, to allow you to proceed with the sales, within the OTP.
You can simply write in the clause, into the pre-printed OTP or get your lawyer to prepare a specific OTP, for this purpose.

It would be simpler to write in the clause in the OTP. You can get the lawyer to draft it for you to make sure that all angles are covered.
