I have recent put down a $1k option fee for a HDB resale flat. The owner is Singaporean, staying in JB Malaysia and has rented his whole unit to some foreign tenants. The owner n his agent assured me that the tenancy agreement will end before I move in but has yet to show me the rental document. Must I see the rental agreement to validate the tenancy period he mentioned? What if the tenant do not move out before my final appointment? What IF i find out the rental agreement between the seller n his tenant stretches to after i get the house key? Am i liable to extend the rental period? Can i evict the tenant immediately without legal consequence to me? Please advise what i need to do right now, I have not yet exercise my OTP and don't want to lose my $1k.

Hi,

To save all future potential trouble, i would advise you to demand to see the tenancy agreement. This is to make sure whatever they claimed is true.

Hi,

Currently , you will stand to lose that 1k deposit should you back out of the deal. HDB transactions are different from private properties where units can be sold with vacant possession or with tenancy. Should you decide to proceed with OTP, the owner will need to produce a handover inspection (subject to your agreement) prior to the second appointment date with HDB. If the unit is still not vacant, you can demand that owner takes the necessary steps to ensure vacant possession.
