Me n my wife are Singaporean and our HDB flat full repayment done long ago. I contributed 70% and she 30% through some cash and rest in CPF. Now due to disputes, we are about to be Separated but she doesn't take any actions legally for that, shrewdly awaiting for me to do, so she could get maintenance alimony!!. Is it possible, since I am the 70% owner, to sell without her consent?. What will happen if I surrender citizenship? If surrender, can I write off my shares, through a Will, to someone else, like a Charity Organization? Thanks

Dear sir/madam,

Sorry to hear about your situation, it is not possible to sell the current HDB without your wife's signature since she is also a legal owner. The splits from the sale of property will be decided by the court after the divorce is finalised, unless both parties can agree to how the proceeds should be split now. You should speak to your lawyer on this matter to ensure that your legal rights are maintained.

By the way, whether this flat was bought via tenancy in common or joint tenancy, your wife will have to ink on the contract too as she is a legal owner. And should both of you decide to go for divorce proceedings, the judge will likely order this flat to be sold in the open market and the cash proceeds to be split between both of you equally in most cases.
