When my tenancy is up for renewal my condo lift will be under maintenance meaning I either move out before my TA ends or pay for extra to move using the stairs. I have asked my Landlord for early release from TA and he has refused. My options are:
1. Leave a month earlier and pay for 2 properties so I can use the lift to move
2. Stay until the end of TA and pay extra for movers.
Can I ask my Landlord to cover the cost of the extra for movers?
Can I ask the condo management to cover the extra cost?
Can I get out of my tenancy a month early as the condo lift is out of action?

Hi, for the early release it will depend greatly on whether there is a early release clause in the TA. are there any other lifts in the condo that you can use, it will rarely be a case where all the lifts go for maintenance at the same time. The condo management as well as the landlord will most likely not cover the cost for the movers.

Cost Sharing for Movers: Propose splitting the additional moving cost due to the stairs.
Check Tenancy Agreement: Review your TA for any clauses related to "habitability" or "quiet enjoyment." While a non-functioning lift might not be explicitly mentioned, it could be argued that it significantly impacts the usability of the apartment. Read More

Hi Clare,

I am sorry to hear about your predicament. Unfortunately, since there is an existing agreement signed with your landlord, any premature termination of lease must fulfill the terms and conditions indicated in the tenancy agreement, otherwise, landlord has to agree to it on goodwill if it is done without any form of penalty or damages to be paid to landlord.

As such, it is now a legal question on moving out prematurely or have someone else to pay for the additional fees for movers. Such questions will be better answered by a legal professional.

Would perhaps be better to invite landlord for a talk on this issue you are facing and hope landlord can show empathy towards this situation and allow you to move out earlier, or with some conditions attached to the early move out?
