Couple sues developer over home defects

A couple has filed a case against Kheng Leong’s real estate developer unit, asserting that the apartment sold to them was unfit for habitation.

After purchasing a unit at Oasis Garden condominium, Mr. Benson Tan and his wife, Amelia, filed charges against Peak Homes Development, seeking compensation for various expenses, such as the rent for another house pending the repair of the unit and the moving costs involved.

The couple claims direct losses in the amount of S$12,146.73, plus interest. For being sold a unit unfit for occupation, as well as for the inconvenience and distress allegedly experienced, the couple demanded an unspecified amount in damages.

In October 2007, the couple purchased the 1,519 sq ft three-bedroom apartment for S$1.08 million. After collecting the keys from the developer, the couple alleged that they discovered numerous flaws in the unit. Substantial defects were evident throughout the unit, including flooring, plumbing and carpentry problems.

Situated in Jalan Bunga Rampai, the apartment is among the 134 units at Oasis Garden.

In response, Peak Homes argued that the majority of the defects were small ones, comprising mostly stains, which would not have made it impossible or unsafe to occupy. The developer added that the couple were impractical in their demands, stating that their expectations exceeded the industry standards set in the Building and Construction Authority’s guidelines.

The hearing for the case is expected to continue on 11 May.
