Can I check if a resale hdb flat is bought with just 1 owner's name while the other spouse (both are married and singaporeans) act as an essential occupier, can the essential occupier go and purchase another private residential property without incurring ABSD? Thanks.

The essential occupier can purchase a private residential property without incurring ABSD only if the 5 years Minimum Occupation Period of the HDB has been fulfilled. Hope this helps!

Hi,

The essential occupier also needs to fulfil the MOP of 5 years after the resale HDB purchase, and can only purchase private residential property after the MOP. No ABSD applicable since she is getting her first property.

The person moving in (essential occupier) must also live in the flat for 5 years (fulfill MOP) after buying the resale HDB.
They can only buy a private property after this 5-year period.
Since this is her first property, there's no Additional Buyer's Stamp Duty (ABSD) to pay.

Hi,

1) The core (essential) occupier concept is only applicable in buying an HDB flat and a new EC.
2) In the IRAS eyes, they will charge ABSD according to citizenship and residential status, and the number of counts in the residential property this person owns at the point of assessment.
3) The HDB restricts all owners and core occupiers from buying private residential property during MOP.
4) So, the core occupier (citizen) may buy a private residential property after fulfilling the MOP without incurring ABSD.
5) But if the core occupier is a PR, he/she will be subject to a 5% ABSD for buying the 1st private residential property.
