Dear Property Guru,
I "sold" my HDB flat and now at the final stage of 2nd/resale appointment for handover. If the buyer now faces issues with his bank loan / not able to get a loan, what rights do i have as a seller for this resale.
I have also vacated the flat for this resale purpose. Thank you.

I guess the best way right now is to seek you lawyer's advise on the matter. You have rights to claim damages, however, if buyer is in a financial situation and cannot pay up, you may not see the compensation anytime soon.

You may seek legal recourse in such a situation but it will usually take a long time and at the end of the day you may not be able to claim anything from the buyer especially when he or she is facing financial difficulties since the buyer should have secured a loan already when the option to purchase was exercised.

I would advise you to settle the issue mutually with the buyer and start looking for another buyer immediately so as not to delay the sale further!

You have the right to ask for compensation if they delay the completion. You may sue the buyer but that will cost you some money and time. If HDB confirmed the deal is cancelled, best to to quickly market for sale and look for new buyer asap. Please drop me an email for me to advice you more.
