Hi, both my partner and I are divorcees with our own HDB both 3 rooms flat. Both units MOP in 2022. We are planning to remarry and upgrade the property. Understand that 1 of the unit will be required to dispose. For such circumstances, how do we about with it?
- Dispose 1 unit first, and 1 of us to purchase a new flat, then get married and add in the other party name into the flat?
- Dispose both unit, and purchase a new flat?
What are the options available around such circumstances? Thanks!

There are a few options which you may consider, depending on your financial situation.

1) Purchase the bigger flat, and then sell off both your current flats within 6 months of the purchase.

2) Sell both flats, request extension of stay for at least 1 of the flat, while you purchase the bigger flat concurrently.

3) Sell 1 flat first to get funding, then purchase the bigger flat, and lastly sell of the other flat latest within 6 months of the purchase.

If you are planning to upgrade to another HDB, both units have to be disposed off eventually when you are married as HDB does not allow married couple to hold on to both flats. What makes a difference is in terms of time planning. You may want to disposed off 1 flat first, purchase another flat jointly and finally disposed off the 2nd flat to ensure both you and partner have a place of stay throughout the buying and selling process. If you are thinking of upgrading to a private property, a good strategy to avoid ABSD while maintaining a HDB and one private property is sell off one flat first and purchase a condo as a single buyer before you get married. There is no problem if you go ahead and get married even if you have not sold both flats as HDB will then notify you to sell one flat and should both flats have not reached its MOP, HDB might be able to grant you an early approval to sell. Both of you have your own 3 room flats and therefore there is a lot of flexibility in your timeline when it comes to the selling and buying. If you have sufficient funds to proceed with the purchase first then I would advise you to sell one of the flat first and purchase your new flat before selling the other flat. This is because in such a manner, you will have not have to worry about not having a place to stay while you renovate the new flat.

If you need the funds from both flat to finance the purchase, then we will need to plan both sale and the purchase concurrently and back to back so that you are able to transit smoothly to the new flat.
