I have been asking authorities, lawyers, and some agents but I do not have any concrete answer and do not know what is my next course of action..

1 ) I was interested in a unit that advertised for $3500.
2) Agent sent me the video as I was unable to go for viewing and really liked it base on the video sent.
3) Checked out the number I was in contact with and is a Registered Agent.
4) Agent told me landlord agrees to proceed at $3600, however upon placing the deposit without any documentation sign, the agent sent me a message saying he has a higher offer at $3700, and pressured/persuaded me to offer the landdlord $3900 and the unit is mine.
5) I agreed but will transfer once I see the unit and sign the agreement.
6) Unfortunately the agent has done some stuff that made me uncomfortable to rent the unit, even after confirming that I will proceed with what he asked for.

a) A viewer was there when I was there for my signing of TA with my wife.
b) The TA was empty and did not have my name filled up.
c) But I signed the agreement as I liked the unit and was ready to transfer the balance rent and outstanding. ( Stamp duty was paid before my arrival )
d) My friend saw the listing online and ask for a viewing, and the agent send the same video and agreed for viewing to be done at 3pm. ( I signed the TA at 12:30pm )

After this, I still believe everything is in place. However the agent did not reply me for 3-4 hours and I panicked, I inform the agent to hold the TA but yet no response again.

I believe the agent has stained the property industry given the number of scams going around.

If the owner accepted my offer, shouldnt the owner sign, I sign, and proceed to deposit / pay for rent ?

Why is viewing arranged after I signed the TA without my name and the agen demanded for me to transfer the money first before sending me the finalized TA.

This whole time I have no seen the agent and given that I was "tricked" , the agent was probably using my agreement to inform another tenant to match or offer higher.

Agent said she will advise the landlord to forfeit my deposit. When she realized the person that arranged a viewing at a later time was my friend, she suddenly called and want to settle it amicably.
Regardless of the deposit, the stamp duty should be refunded back to me immediately right ?

Hi,

Yes I believe you have a good case to fight and as for the landlord agent, she would probably be getting a suspension if you will to make a complaint to the CEA.

To be fair, after going through your scenario, there is really nothing much we are able to advise, except to file a report against the agent and/or the landlord if deposit is in his account. While we understand the logistical concerns about not being able to be present physically for viewing the apartment before you can decide on making an offer, in the absence of your physical presence, the next best thing to do is to ask a friend or colleague at work to assist your with the physical viewing in order to potentially snuff out any misdoings like scams and etc.

I can't really determine in this case whether is it a scam or not. Did you enquire the listing via PropertyGuru or other channels? In terms of refund of the stamp duty, you will need to write in to IRAS to have your stamp duty refunded, if it is indeed sent for stamping proper, and you will need to write in to IRAS to request for the refund. It is likely going to take some time for the refund to take place, in order for verifications and investigations to take place.
