Hi, would like to ask . if the tenant have paid booking fee for rental booking before moving in .. Let say the tenant cancel and found another place before moving in.
The rental deposit is forfeited.
Does the agent have the right to claim half the deposit from me

Did you sign any agreement to indicate that 50% of the deposit can be claimed from you in the event of forfeiture?

Let's put it this way, I always believe in win-win scenario, given that advertising costs these days are escalating, the 50% of the deposit forfeited could still go a long way in reimbursing for the advertisements put up, ultimately you also get to keep 50%, but the actual situation on ground could be different thus you may have other considerations too. Should always keep it open for discussion.

That depends on the agreement made with your agent. If the commission document has been signed and if it is stated that in the event the deposit is forfeited, that you have to pay half to the agent, then you will have to. However if there has been no such agreement, you may speak to your agent on it.

YES, example in my commission agreement form , i would state that " The rental booking fees is forfeited., me as agent will be entitled 50% of it , eg . $5k rental , i will be entitled $2500 for (1) MY EFFORTS AND (2) MARKETING COST , WITHIN WHICH > THERE IS NO $ TO BE FORFEITED AT ALL > AND LANDLORD WON'T EVEN ENTITLED TO 50% , $2500 . IN THIS EXAMPLE.
I will only cooperate and SIGNED into a commission AGREEMENT with landlord WHO IS FAIR AND REASONABLE AND NOT ONLY THINK OF HIS OWN BENEFITS AND NOT CONCERN THE BENEFITS OF THE AGENT IN (1) AND (2) ABOVE . I WILL TELL OF MY FAIR LOGIC AS WELL .
