If sole owner of hdb flat died intestate, is it true that the beneficiaries who are also descendants of sole owner will be able to delay the compulsory disposal of flat as long as existing room tenants keep on renewing their lease at each expiry?

Good evening,

Upon the decease of the sole owner, NOK or the child have the right to appeal through court to take ownership of the asset. However, this is provided that there is no contest on the application. With the court order, you can apply for transmission so that the ownership transfer can be done. Do note that renewal of lease is not possible as the rightful owner would not be available to ink the lease.

Hi,

First of all, you have to identify who is the beneficial/successor.

(1) Not married: 100% to parent(s)
(2) No parent: 100% to sibling(s) or children of deceased sibling(s)
(3) No parent or sibling: 100% to Grandparent(s)
(4) No Grandparent: 100% to Uncle(s) & Aunt(s)
(5) No relative: 100% to Government / State

The priority is according to the above sequence. If you are under any of the above, then you worry about the first question.

(A) Delay compulsory disposal of flat
It is given a grace period of 6 months to dispose, any extension can be apeal case-by-case basis.

(B) Renewal of tenancy
This shall dependent on the new owner whether he/her is eligible to take over the flat. New owner of course can renew the lease.
If the new owner owns another HDB flat, then it is a straight forward case, he/she must dispose off the flat within 6 months.
