Asked by
I am renting my HDB bedroom out. My agent managed to find me a tenant and doing up the tenancy agreement now. However I am not satisfied with some of the wordings of the terms or not clear with the terms. So I requested the agent to rephrase the sentences. But agent keep giving reasons for not rephrasing. Can I insist on rephrasing? And although is just room rental, should we be cleared on those terms which suppose to be common terms?
Please can someone enlighten me. Thanks

Hi,

Yes anything is possible and everything is negotiable. As long as both the tenant and landlord can agree on the matter.

You can do up your own room rental agreement instead of using the agreement done by the agent. As long as both landlord and tenant are agreeable on the terms and conditions, sign on the agreement that matters. Most agencies have their respective templates which are supposed to be fair and neutral to both parties when transacting a deal. You do not necessary need to use such templates. Read More

As a landlord, you have every right to be fully satisfied with the terms of your tenancy agreement before signing it. The tenancy agreement is a legally binding document, and it is crucial that all terms are clear and agreeable to both parties.

1. *Rephrasing Terms:* You can insist on rephrasing any part of the agreement that you find unclear or unsatisfactory. It's important that the language used in the agreement is understandable and accurately reflects the terms agreed upon. Clear communication and understanding between you and your tenant can prevent future disputes.

2. *Common Terms in Room Rental:* Even for a room rental, certain terms should be clearly outlined in the agreement. These typically include:
- *Rent Amount and Due Date:* The amount of rent, payment due dates, and acceptable payment methods.
- *Deposit:* The amount of security deposit required and conditions for its return.
- *Duration of Tenancy:* The start and end dates of the tenancy.
- *Utilities:* Responsibility for utility payments (e.g., water, electricity, internet).
- *Use of Common Areas:* Rules regarding the use of shared spaces like the kitchen, living room, and bathroom.
- *House Rules:* Any specific house rules the tenant needs to follow (e.g., no smoking, no pets, quiet hours).
- *Termination Clause:* Conditions under which the tenancy can be terminated by either party.
- *Maintenance and Repairs:* Responsibilities for maintenance and repairs within the rented room and common areas.
- *Visitor Policy:* Rules regarding visitors and overnight guests.

3. *Consulting Your Agent:* While your agent can provide valuable advice, the final agreement should meet your satisfaction. If your agent is reluctant to make changes, you might want to consider consulting another agent or seeking legal advice to ensure your interests are protected.

By ensuring all terms are clear and agreed upon, you minimize the risk of misunderstandings and disputes during the tenancy.
