I am selling my HDB flat soon and I have issued my Option to Purchase to my buyer, who has yet to exercise it. The buyer and I have mutually agreed on a 3 month extension after the completion date set by HDB and I have to sign a Letter of Indemnity. Is it compulsory that I must let the buyer and her contractors/interior designers etc enter my flat at will during these 3 months? Or do I still have legal control over whether the buyer can come in anytime?

Hi,

1) This is a negotiation between the seller and buyer under a private agreement.
2) You should state your conditions and the buyers also can raise their concerns.
3) Personally feel that signing a Letter of Indemnity is unnecessary.
4) Since the buyers can only start their renovation after the expiry of the 3-month extension. By that time, the buyers already become the legal owners of the flat. They don't need that to apply for a renovation permit.
5) There are no strict official standards or rules to follow under a private agreement.
6) My opinion is you might want to give a maximum of 3 visits during the 3-month extension period or even 1 visit for them to take any measurements they need.
7) The buyers should have discussed with their contractors or renovation ID to firm up the works they wished to carry out at their office and not in your flat.
8) The fact is the ID will use the floor plan as a guide to provide a quotation rather needed to come on-site.
9) Those critical measurements could only be carried out after dismantling all the fixtures. You should have already moved out of the premises by then.
