I own a private property jointly with my spouse who has since passed on. The property is still held under our joint names.
1. In the event that I sell the property, will there be any complications with the transfer to the new owner? Can I execute the transfer myself, I.e with one name?
2. Do I need to update ownership prior to the transfer?
Grateful for your advice please.

Hi,

My condolences and sorry to hear about your loss.

If this property was held on joint-tenancy, your spouse's share of the ownership will automatically transfer to the remaining owners (you) under the rights of survivorship. You have the legal right to decide whether to keep or sell the propety. It is still required to update SLA with the notice.

For property jointly-held between spouses, the ownership gets transferred to the surviving owner by default, unless your spouse had previously did a Will. If he/she had a Will, the ownership will be passed down in accordance to the Will. And in this case if you're not sole owner, you will need the beneficiary's approval for the sale of the property.

Good afternoon,

Given your case, it would be good to know if there was any WILL be drafted by your late-spouse for the unit. If no WILL had being drafted, you can present the Death Certificate to SLA and work on the transfer. However, if there is a WILL, I believe the executor or administrator will be contacting you soon.

Dear friend,

There are 2 types of joint name.

Tenancy in Common and Joint Tenancy.

You need to know which types of Joint names you and your late spouse used when the property was purchase.

in Joint Tenancy, both holds equal shares.
when one passes on, the shares automatically transfer to the surviving owner.

In Tenancy in Common, there exist of split of shares, usually 50%50%. Some couples may decide 30/70 or 10/90.
This % is decided at the point of purchase of the property.
In this case, the share of the deceased party WILL NOT BE TRANSFERRED AUTOMATICALLY.

If the deceased has WILLED the shares to another person, then that named person will INHERIT the shares.

Do check your property title deeds or with your lawyer to be 100 pct sure.
