Good day to you,

Under the Non-Citizen Spouse Scheme, the main applicant must include their spouse as an essential occupier. Neither the main applicant nor the essential occupier can own any private properties, whether within or outside of Singapore. If they do own such properties, both the main applicant and essential occupier must fulfill a 15-month wait-out period before they become eligible to purchase property.

With over 15 years of experience in Singapore's residential property sales and purchase (S&P) cases, I understand the complexities involved in the process. I aim to guide you every step of the way with clear communication, ensuring that all parties are legally represented and protected.

Hi , HDB has specific rules regarding property ownership for both the flat owner and occupiers. According to HDB's regulations, essential occupiers (including a foreign spouse) are generally not allowed to own or have an interest in other properties, whether local or overseas, during the Minimum Occupation Period (MOP) of the HDB flat. This rule ensures that the HDB flat is the occupier's primary place of residence.

Here’s a summary based on HDB's guidelines:

Essential Occupiers: If the foreign spouse is listed as an essential occupier in the HDB flat application, they are subject to HDB's rules. This means they cannot own or have an interest in any other properties, including overseas properties, during the MOP.

After MOP: Once the MOP is fulfilled, the foreign spouse (as an essential occupier) may be allowed to own overseas properties, but this should be confirmed with HDB directly, as rules may vary depending on specific circumstances.

Declaration: Both the flat owner and occupiers must declare their property ownership status to HDB. Failure to comply with these rules can result in penalties, including the requirement to sell the HDB flat.

For the most accurate and up-to-date information, I recommend checking the official HDB website or contacting HDB directly. You can refer to the following HDB page for more details:

Hi

The answer is no, as both owner and essential occupiers need to have sold or transferred all local or overseas private property ownership before they are eligible to apply for HDB. For resale HDB in this case, it is a 15 month wait out period after the private property sale, before they can apply for resale HDB.

Hope the above clarifies. I am well-versed with HDB and private property transactions, having helped more than 100 homeowners transit smoothly with their housing plans. Please reach out to me at 97432395  for a more in-depth discussion :)

May I have more info on your requirements so as to make better recommendations? Thanks and looking forward to chat more

Hi,

1) According to the current policy, anyone buying an HDB flat (BTO/SBF and resale) are not allowed to own any shares in a private residential property locally and in overseas.
2) Do note the restriction is private residential property. The party concerned can still own industrial and/or commercial property.

All the best!

Please give me a thumbs-up if the answer provided is relevant to your main concern. Thanks!!!
