If I currently hold an EC of 5 years, but my parents just passed away and will their HDB flat to my son who is yet of legal age to take ownership. Can we as guardians of my son of 4 years old be the trustee for the HDB flat till my son turns 21 of years and decide what to do with the flat? Or HDB will insist that we have to dispose the HDB flat on behalf of my son because he is an essential occupier of our EC which is still considered HDB ownshership in the first ten years?

Evening,

Anyone under the age of 21 cannot be the owner of Any property in Singapore. Your parent's lawyer should have advice the trusted on this particular issue. Depending othe content of the Will, it's likely the duty of the executor who will manage the estate till your son is of legal age to take over, unless stated otherwise.

Check with your lawyer on the detail and content of Will for clearer picture.
