Hi,

It will be based on the higher ABSD rate of the applicants, meaning 12% if he is Singaporean buying 2nd residential property. It does not matter the percentage of ownership even though he is taking less percentage.

But there could be other ways to optimize the tax planning when doing the purchase. Happy to share more on the best approach to structure the next property purchase if I can have more information.

The ABSD rate applicable will be based on the profile with the highest ABSD rate on the entire property value acquired, i.e. based on your spouse's ABSD rate on 100% of the property.

The ABSD will apply if either one already have property at the time of purchase and will apply 100% of the purchase price.

There might be other alternative which you can consider but will need to do a prudent planning to ensure that it is feasible for you.

Hi,

According to the IRAS guideline, when you sign the S&P together, ABSD is computed according to the highest rate possible.
In your case, since your husband is buying 2nd property, thus subject to 12% ABSD.

My suggestion is it is in your best interest to speak to any agent or lawyer before taking any action.
