Is my agent trying to CON me? Need an advice.

I signed an exclusive estate agency agreement for the sale of residential property (form 5) with an agent from a reputable estate agency in Singapore.

The commission rate is 2% & 7% GST-registered estate agency as stated on the agency website.

The agent marketed & sold my HDB flat, HDB has approved & now waiting for completion date.

Then, the agent reminds me to prepare the commission; which is 2% of the selling price of my HDB flat + 7% GST directly to agent’s personal account via PayNow instead of her agency on the completion date.

I felt weird because the form 5 stated the agreement is between me (seller) & the estate agency & the agent is a salesperson representing the agency.

I tried to clarify with the agent & asked isn’t the commission supposed to pay the agency? I showed her the agency website as stated Payment for commission shall be made payable to XXXXXXXXX & not the individual Salesperson. I felt uncomfortable with the agent whatever motive she has.

I want to ask the Guru and/or any agents can advise:
1) Is it a practice to pay agent’s commission directly to agent’s personal account via Pay Now?
2) Does an agency allows their agent use the form 5 agreement letter with the agency’s logo to conduct sale for client & don’t need to declare to the agency?
3) Can an agent bypass his/her agency to receive the commission inclusive of 7% GST?
4) Can an agent receive 7% GST in his/her personal account?
5) Do I get a receipt from the agency after payment of agent’s commission?
6) If I pay the commission directly to agent’s person account via PayNow, will the agency comes after me for payment again?
7) Will I get legal sue by the agency even I told them their agent told me to pay their commission to his/her person’s account via PayNow?

Why don't you check with the agency instead if such an arrangement should be made. Also, did you receive the invoice from the agency or from the salesperson direct?

I guess you should also hear her out on explanations. In typical arrangements, all payments should be made to agency instead.

Hi, the correct way will be wait for the invoice from the agency to arrive and then you pay up via cheque or transfer via the company account. Once the agency cleared the payment, they will issue a receipt to you.
