My situation now is this, I have a private property now with my wife. I want to buy now one/two resale/new condo but I will need to pay the ABSD, unless of course I sell first then buy 2 units under each name.

Can you suggest any other way to avoid the ABSD ?

Hi Mr. Goh,

Another way is to do a decoupling of the current private property, where one of the owners remove their ownership from the current property. This name will then purchase the next property under his/her sole name. As its without any residential ownership, there will be no ABSD applicable if its singapore citizen purchasing 1st residential property.

However, de-coupling comes with its drawbacks as well, as the finances must be comfortable and of course it being a sensitive issue since now its separate ownership. Hi Tom,

For your situation, there will be 2 options to avoid paying the ABSD.

1) Decouple the current property that both you and wife own. One party will buy over the share from the other party. The cost involved will be the normal buyer stamp duty and the legal fees.

2) The other way is to restructure your property portfolio by selling off the current property and buying 2 properties, each under one name.

There are generally a few ways to avoid paying the extra stamp duties. The most common way would be the one that you have suggested.

Another method would be to do "decoupling" of your current private property, and then purchase the other property using the decoupled name.

Good evening Tom,

You can consider decoupling other than the outright method that you have in mind.

Either party buys over the other party's share. But you have to review whether is it justifiable to do so rather than simply sell off existing asset and buy two under individual names in terms of legal fees, stamp duties, paying the other party's CPF with cash etc.

Perhaps we can evaluate your existing asset in terms of its current price (whether has it peak), potential for future growth (location, property age etc) then we might have a better idea which method suits both of you better.

Alternatively to avoid ABSD , you may consider decoupling, decoupling is NOT divorced , using a example of a one million dollar existing owned private property and a 50/50 joint tenancy ownership , this administrative exercise or decoupling will cost you approximately 15k in total , comprising of stamp duty payable to goverment and legal fees . NO property agent fees in de coupling .

There are few other factors to note , including this existing property has to be easily financed by one person cpf and income only , meaning NO co-payment except for cash co payment allowed in this property that is being de-coupled .
