My wife and I plan to decouple. She will 'sell' her 50% share to me so that she could buy a new HDB flat with our son (21 yo).

However, HDB has a rule that "have not disposed of any within the last 30 months". Does this rule apply in decoupling as well?

Hi,

Yes decoupling is considered selling your part share of the condo as well, hence its not feasible to be eligible for hdb. Unfortunately hdb will also require your name to be added to form the family nucleus as well.

Good evening Sir,

I am afraid to inform you that buyers have to form a family nucleus in order to purchase a resale HDB. In such situation, you have to be either owner or occupier with your wife in order to purchase. In which you will have to dispose off your private property within 6 months from resale HDB purchase completion if you wish to do so.

And as both of you are private owners right now, you have to dispose your private first and observe waiting period of 30 months before you can apply for BTO.

By the way do you mind sharing more about your intention to purchase a BTO?

Dear Sir,

Under the current ruling, it is not feasible unfortunately because when purchasing a HDB flat (BTO or resale), if one of the buyers is married, his or her spouse will need to be the buyer or essential occupier. In this case, if your wife and son were to purchase a HDB, your name will need to be added and you will need to sell your private property within 6 months.

For your situation, it may make sense if your wife and son purchase a private property instead. Please feel free to contact me so that I can understand your situation and propose a solution to you!

Hi Sir,

I wish to inform you that your plan is not feasible. This is because if your wife were to purchase a HDB flat, your name will be needed to be included, either as a co-owner or an essential occupier. In both cases, you will have to dispose off all interest in other properties within 6 months upon the purchase. Both you and your wife will also need to fulfill the 5-year MOP before you can purchase another residential property. If your son is included, he will also be bounded by the MOP rule.

Also, in order for you to apply for a new HDB flat from HDB, both you and your wife will have to dispose off all interests in all private residential properties, wait out a period of 30 months, before you are eligible to apply for a new flat. This is also provided that your household income ceiling does not exceed $12k.

If your plan is to own a second property and minimize ABSD payable, there may be other options which you may consider.
