We have an apartment under my spouse and my name and is using both CPF to service the bank loan. If my spouse will to transfer his share to me :-
1) Do I need to pay back his share to put back to his CPF account?
2) Can he still use his CPF to continue to pay for this loan?
3) What are the charges incurred in transferring and how much?

Hi Mdm,

May I know if you're referring to HDB or private property?

If it's a HDB apartment, there is no way the transfer can be done.

If it's a private apartment, it is possible to transfer his shares to you. If all his shares were to be transferred, all CPF usage will have to be returned upon the transfer. If only partial shares was to be transferred, and he remain as a co-owner, there is no need to refund the CPF, and he can continue to use his CPD to finance for the apartment.

Charges will be the stamp duty and legal conveyancing fee.

if under private properties, it can be done.

As regards to your question, yes you will need to pay back the cpf utlise. Treat is as shares. how much he paid, you need to buy over.

You need to take note on your own TDSR able to take up and service the balance loan by yourself.

so you can buy over 100% or whatever percentage. if he has 1% share, he can still use his cpf to service the loan.

Fees incurred will be lawyer and conveyacing fees,
Stamp Duties of the amount (Shares) (estimated 3%)
Seller Stamp Duty if any.

Dear Sir/Mdm,

1) Yes you will need to pay back his CPF that he has utilised for the property. You can either use cash or take a loan to repay this amount.

2) If he has sold all this share to you then he will not be able to use his CPF to service the mortgage anymore.

3) The total legal fees is about 6-7k.
