Asked by
Me (Singaporean) and my wife (Singapore PR) have a hdb flat under joint tenancy (equal share). My wife Singapore PR has expired.
My wife is a house wife and haven't contributed any money to pay the hdb. 100% payments done by me.
Now she is not co-operating to transfer her ownership to me (wife spr expired). Is there any way to transfer her ownership to me? So that I can retain my hdb flat.
Do I need to appoint a lawyer?

Please advice?

Thank you in advance

Hi,

1) All conveyance work in Singapore required a licensed lawyer to do so.
2) Even though your wife did not contribute anything in terms of finances in your flat, she is still entitled to the 50% share of the HDB flat.
3) Therefore legally you will still need to pay your wife the 50% share value.
4) Legally your wife will have no choice but to do such transferring because a foreigner is not entitled to own any shares in an HDB flat.
5) You may retain your HDB flat as long as you meet the eligibility scheme listed by the HDB after the transfer.
6) I would suggest you contact a conveyance lawyer's assistance in letting your wife know why she has no choice but to transfer her share to you.
