What happened if the resale flat Im looking to purchase is still tenanted by the seller. Can I seek any reimbursement from the seller since there's a delay (probably a few months) in handover of flat?

Dear sir/mdm,

HDB flats cannot be sold with tenancy. It must be delivered vacant possession unless the seller requests extension period for up to 3 months maximum if they are eligible for the extension due to purchase of a new place which is not ready for moving in.

Hi;

The sale of HDB is subjected to vacant possession( meaning no tenancy attached) as the first 5 years before MOP, you are not eligible to rent out whole unit.You may like to check with your agent regarding the arrangements of such as it is usually pre-agreed before hand on the delay of handing over.. By the way, if you are referring to a HDB flat, then it is not possible for you to buy it with tenancy as the tenant will have to leave the flat before the completion date is up.

For HDB flat, the flat you purchase needs to be handed over with vacant possession. Even in the case of extension of stay, it will still be illegal for the previous owner to continue renting out the unit as the legal title has been passed to you and your house has not met it's MOP period for you to be eligible to rent out your unit. If there is still a valid contract between owner and tenant, it is up to the owner to settle the issues with the tenant themselves. Hi,

No issues here. The tenants will just have to vacate the property before the legal completion of the flat. The owner will have to inform the Tenants that the flat has been sold, and the Tenants will have to make alternative housing arrangements. There is no compensation or reimbursement.
