Whose responsibility and liability?
My father intends to purchase a condo property. Price negotiated and accepted by the Seller. Details given to the Seller's agent, OTP document prepared. Now the Seller's agent wanted my father (more than 80 years old) to go to the condo location to sign the document and hand the cheque. This is for the agent's own convenience, refusing to go to my father's home. Now, if my father walks away without signing and handing the cheque, what is the responsibility and liability of the agent?

There is no right or wrong answer. It only boils down to convenience, whether for the agent or for your dad. If I were to be in the agent's position and I want to close this deal badly, even if your dad is located on the opposite end of Singapore from me, I will also head down to finish up the administrative part of the deal.

The only thing I can conclude is that if there is no exchange of Option To Purchase and deposit, it means no deal.

If there is no cheque and no signed OTP, then there is no deal—meaning neither party holds any obligation or liability. However, if I were the agent, I’d be willing to go anywhere, anytime, to meet your father and close the deal.

1. Whether to proceed depends solely on convenience — either for the agent or your dad. If the agent is eager to close the deal, they should be willing to travel across Singapore to complete the paperwork.

2. No exchange of Option to Purchase (OTP) and deposit means no deal. The seller's agent must act in the seller's best interest, which includes preparing the OTP to confirm the agreed price and terms.

3. Until the OTP is signed and the Option Fee is paid, the buyer’s offer remains non-binding. Clear communication is vital to avoid misunderstandings and facilitate a successful transaction.

If the signed OTP is not delivered to the buyer and the option fee is not received by the seller then this deal is not binding.

As an agent myself, it is my job to make sure the deal is completed smoothly and efficiently even if it means going the extra mile. However, to give the benefit of doubt, the agent could have his reasons for not being able to make that delivery. Having clear communications between both parties may help to avoid misunderstanding.

Hi,

1) This agent is a deal breaker! No idea why he/she is doing that.
2) An agent's responsibility is to act at the best interest of the sellers.
3) In your situation, no one is liability from a legal point of view since there are no contract relationship built between both parties.
4) A contract only formed when there is an interest exchanged, i.e. money exchange, although there is willing partys' verbal offer and acceptance in the process.
