I do understand the frustrations of a landlord when there is no one taking up the property for rent, but I believe the current market is relatively bad for every landlord out there, with rising property taxes as well as conservation charges to pay.
As far as agent are concern, if you have already paid them to find you the right tenant, base on the service agreement you have, you can perhaps sue the agent, however, if you have only engaged the agent to find you a tenant, and only pay them if they are successful, I do not see any grounds for you to sue the agent.
It could be precisely because on the lack of prospective tenants for your unit that he or she is coming back to you on the profile of prospective tenants who are checking on your unit. If you are not prepared to open up your restrictions, then you cannot also blame the agent. Open communication is key. I have a unit that is vacant for 2 months and we have adjusted the rental expectations downwards on 3 occasions before we start receiving enquiries.
If you are unable to hold on to this property due to the lack of rental, how about listing it for sale? If you are able to sell off this property, you will not be subjected to this spell of weak rental market in future too and reinvest the funds into something else?
