Dear Guru,

I am looking for a 4 bedroom condo unit for rental and after 2 years i would want to buy the unit from the owner. is such thing possible?
rental budget:$3000 - $4000

I currently live in a 3 bedroom BTO flat(MOP 2019). The house is too small for my family to live in. I understand i cant sell or buy now.
So I am looking for a unit that i can rent first then own it later after i sell my flat.
I would also want to rent out my home (lock one room).
Please advice

Dear Mrs Pushpa,

As you have not met your MOP for HDB, the requirement is that you should be physically staying in the apartment itself, therefore locking up 1 room option which I heard that others are doing is still falling foul of the regulations.

Given your genuine need for bigger space than your current 3 bedrooms apartment, you can perhaps write in to HDB to appeal for selling it before MOP.

With regards in terms of rent to own, it is definitely possible, if terms and conditions are set right and agreeable between the owner of the property and yourself. I have to say, it is definitely not easy to work out the terms and conditions which would not disfavour any party in this transaction.

Hi Mrs Latha,

You may want to appeal to HDB to allow you to sell earlier and upgrade to a condo due to the space constraints that you are facing. I have assisted a few of my clients to appeal successfully before and they have sold their HDB before the MOP ends.

As to the possibility of renting for 2 years and subsequently buy the property, it will depend on the owner. Owners are generally not receptive to such an arrangement as there is no assurance that you as the tenant will purchase the property from them 2 years down the road and there is a good chance that the market conditions will change in the future.

If you have a genuine need for bigger living space, you can try to appeal to HDB for early approval to sell before MOP. It will be on a case-by-case basis. However, do take note that SSD will apply should you sell off within the first 4 years.

My seller successfully appealed to hdb for selling before MOP , however her circumstances are very different from you , it was due to hardship and she was in arrears with her hdb loan , in addition , she had to pay a penalty SSD sellers stamp duty which was very substantial .

If you are not prepared to pay the SSD penalty , you probably have to wait out the MOP .
