[Foreign spouse with property, can apply as married couple or no?]

I'm (32F) single with plans with my (38M) partner. He has his own property in the US, and has family in the states. We do not intend to falsify any information, but given this situation alone where it is unlikely that he will migrate to Singapore, am I able to apply for a resale flat as a married couple after marriage? Does he need to be listed, and will he need to give up any property?

Hi,

If you are planning to buy a resale flat as a married couple, your spouse's name will be registered in the HDB flat. However, since your spouse owns other property in the US, he is not eligible to become an occupier of the HDB flat.

If he wants to be listed an occupier, he need to dispose his property 15 months before you apply for HFE letter if you are not taking HDB loan or CPF housing grants, 30 months before if you are taking HDB loan or CPF housing grants.

Hi,

nfortunately, the answer is no. HDB considers a married couple as a single entity, meaning his name must be listed as either an owner or occupier. You cannot proceed with the purchase alone.

Since he owns a property in the US, he will need to dispose of it and wait for 15 months before both of you can apply for the HFE to purchase a resale HDB in Singapore. However, if both of you are above 55 years old and plan to buy a 4-room HDB flat or smaller, the 15-month waiting period does not apply.

If you're planning to purchase a BTO flat, the waiting period will be 30 months instead.

If you were to apply hdb resale as a married couple, you need to add his name as occupier, and he needs to sell away or give up his overseas property, and wait out 15 months first. It may not be ideal for you guys, so suggest to get private property instead if you all prefer to keep the overseas property.
