Hi
I am leaving Singapore in the month end due to relocation. And was searching for tenency takeover. Via agent we got a potential tenant. A week back he has paid the SD to the ower. He has not signed any LOI/TA with the owner. Now due to some reasons he is not occupying. This would cost me to pay the rent to the extent of unoccupied months (5 months). I see no fault of mine here. Is there any remedy for me or this is something that owner and the stepping back tenant has to sort out without causing loss for me.

It depends on the exit agreement you have with the landlord for the premature termination. As far as most landlords are concern, the back out of the new replacement tenant has nothing to do with them since you are the one looking to exit and landlord has agreed for replacement tenant. Since this tenant has not officially replaced you, you still have the obligations to fulfill the tenancy agreement until someone officially takes over your lease and has entered into a legal agreement to do so. Review Existing Agreement:

Check your current tenancy agreement for any clauses related to early termination or transfer of lease. Understanding your contractual obligations can clarify your rights and potential liabilities.
Agent's Role:

Discuss the situation with your agent. They might be able to mediate between you, the owner, and the potential tenant who backed out.

Hi
- The paid Security Deposit (SD) should typically secure the tenancy, but without signed agreements, you might face a legal gray area.
- This situation should ideally be resolved between the owner and the stepping-back tenant.
- You can try negotiating with the owner to find a replacement tenant quickly to minimize your losses.
- Engaging a real estate agent for professional advice and assistance can also help expedite finding a new tenant.
