i wana ask how is the proceeds of selling of HDB flats for divource cases calculated?
Flat is held under joint owner for husband and wife.
Some arbitrary scenario:
HDB selling price: $500k
Outstanding loan say is $200k, say HDB Loan.
For husband, CPF used previously amount withdrawn + Accrued Interest = 200k
For wife, CPF used amount withdrawn + accrued interest = 20k for example.
For simplicity, assume agent fee = 0
, legal fee = 0, mortgage loan pre-payment penalties = 0 to keep things very simple.
How is the cash proceeds calculated?
Option A)
HDB selling price $500k - pay off HDB loan $200k - return back to everyone's CPF $200k husband wife $20k = $80k left.
So take this 80k cash divide by 2, so husband and wife each receives $40k cash each???
Option B)
oh the HDB selling price $500k needs to pay loan $200k first = $500 - $200k = $300k
Then take this $300k divide by 2: $150k each.
For husband, $150k goes to u, but sorry, u have utilised $200k from ur CPF+accrued, so u need to net net top up $50k back to ur own CPF? and for cash u get nothing of cos.
For wife, same $150k goes to u, but u have utilised $20k from CPF+accrued so, $130k cash goes back to u. huat ah?
Which is correct? A or B? if neither is correct, can you give an example how it is calculated?
