Hi. I will 34 years old this year, divorced with a child. My current court orders states that my ex husband will transfer his ownership of the flat to me but due to my financial circumstances, we have decided that I will transfer the flat ownership to him. We are in the midst of amending the court order and will
Be able to settle this buy Feb 2025. Once the court order is out we will proceed to start the transfer process with hdb. My question is will I be eligible to participate in the Feb 2025 sales of balance? I am unable to apply for bto as I do not have a place to stay after the transfer happens. I will have to rent out and stay alone without my son until I can find a housing for myself.

Hi, you will not be able to do so if you do not have a valid HFE on hand by then. Unless you can try applying for an HFE now.

With the court order being amended on Feb 2025, your ex-husband can proceed with the part purchase on your share. The process will take about 2 months, before the CPF fund and cash proceed, if any, will be in your hand.
Being at age 34, unless you have custody, care, and control of your children, you are not eligible to purchase an HDB unit under the Single Scheme.

1. You can apply for HFE after obtaining an Interim Judgment and settled the ancillary matters on your matrimonial property and the custody, care, and control of your children.

2. With the HFE, as you are 34 YO, you are unable to participate under the Singles scheme. You can still participate under the Public scheme with your child as the co-occupant if you hold the legal custody, care and control of your child. This is not a priority scheme regardless, which means that your chances of a SBF unit is low. Under the current balloting for SBF, only 2% of flats are allocated to second-timers without priority schemes.

3. You actually have better chances for BTO than SBF given that there is a priority scheme exactly for divorced parents, called ASSIST. where 5% of standard flats are allocated for this purpose. However, it is only for 2room flexi/3 room.

4. On the issue of rental, should you secure a flat with HDB, as a divorced parent with child you could be eligible for Parenthood Provisional Housing Scheme (PPHS), which provides you with low rental rates from HDB while waiting for your new flat. So I wouldn't put off a BTO decision if you are eligible:

You will only be able to participate in SBF when you have a valid HFE. You may try applying for HFE now and see the outcome if final judgement has been obtained for the divorce proceedings pending the changes to the court order regarding the management of the existing unit.
