Hi,
Me & my spouse are likely to separate ( due to misunderstandings ).
Currently we jointly own an EC - which we plan to sell & split the sale proceeds.
For HDB, to buy a 3RM or 4 RM is there a possibility to buy 1 unit under 1 person ( as owner ) & other as occupier ( with same family nucleaus ) & the other spouse possibly buy the separate unit as "singles scheme " after court proceedings as mutual consent divorce ( or ) can we apply deed of separation to buy an unit individually ? What would be the best option to move forward. ?
Once we list to sell our current unit, we need to know what would be the next set of actions. Appreciate your valued inputs. We might engage one of you - who could give us the BEST advice.

By the way, you could only proceed to purchase a HDB flat after the wait out period of 15 months and so meanwhile you could appeal and at the same time rent a room or a flat right after selling the EC.

Hi,

1) To go a separate way should be the last option.
2) As for your property question, you now own private property (EC is also considered private property). You will have to observe a 15-month wait-out period before being eligible to buy a resale HDB flat.
3) And to be eligible to buy BTO/SBF, you will have to observe a wait-out period of 30-mth.
4) So the next steps you have are either to fork out more funds to buy a private condo or to rent a place to pass this 15-month period.
5) You will have to apply for an HFE if you still want to buy an HDB flat, which takes 3 weeks to process after the 15 months before being eligible to place a deposit for an OTP.
6) Whereas for the legal separation process, it is best to consult a family lawyer.
7) I only know that uncontested cases will need at least 3 yrs of separation. And a contested case needs at least 4 yrs of separation before you can submit your divorce application.
8) The whole legal divorce process will take 6~9 months to complete before you could get the final court order.
9) So all-in-all, it will be another 3 yrs + 9 mths + 3 weeks ~ 3 yrs 10 mths before each of you could opt for an OTP. This is if you sell your property during the separation period.
10) Anytime during this separation period, you will still be deemed as a married couple, so not allowed to buy HDB separately.

Hi Sir/Mdm,

Sorry to hear about the situation, I hope you are managing well. Firstly may I know if the MOP of 5 years of the EC has been met? If not, you will have to appeal to sell within MOP period with official documents from the courts that you will be filing for divorce.

I presume you guys are below 55 years old. The next tricky thing will be the 15 month wait out period both of you have to observe after the sale, before you guys will be eligible to purchase resale HDB. We may be able to appeal to have this period waived since it is a divorce case, but it may not be guaranteed. Supposed it is not possible, then you have to plan for a 15 month rental or interim stay period with your parents or other loved ones.

Once the 15 month wait out period is over, you have to be 35 years old (single or divorcee) to be eligible to purchase resale HDB under your sole name. You can also add in your child (if any) as an essential occupier to be eligible. You can add in your parents name as occupier as well but this means they have to sell their flat.

There is no need to wait out 15 months, if you purchase a private property right after this EC sale. This is the more straightforward option.

After the sale of your current EC, which I assume have already met its 5 years minimum occupation period, you are not allowed to purchase a resale HDB or BTO immediately. There is a window period of at least 15 months to wait before you are eligible to purchase a HDB, provided you still meet all eligibility criteria. Unless you are aged 55 years old or above, then you are able to purchase a resale 4 room flat or smaller unit immediately after the sale of the EC, if you meet other relevant criteria, mainly basing on the scheme or family nucleus. The description you have provided is quite vague for us to really advise and provide input as there are still missing information.

First of all, you would be able to sell your current EC if your 5 years MOP is met.
Secondly, since both of you are above 55, there is no 15 months waiting time but take note you can only buy 4R resale HDB or smaller.
It is possible for u to buy as 1 core owner + 1 essential occupier (with the same family nucleus), however, we also have to make sure some other criterias are met.
