Asked by
Hi, my buying agent is from ERA. After the purchase completion, we were not advised to check and provide the amount to get reimbursement from the seller for the 1 month extension of stay.

We only knew about it when our selling side, the buyer ask us to pay $X for the cost incurred during the extension of stay.

We checked with our era agent and she just replied she is “not privy to the info” and whatever amount we had to tabulate ourselves. She in her capacity as an agent (with so much experiences) did not advise accordingly. Her job was merely forwarding whatever we sent her to the seller agent.

I asked why we were not advised by her regarding the reimbursement and she said usually the law firm will advise. I was like, we went to the law firm that she recommended and the law firm did not advise anything further after the purchase completion. So agent pushed the responsibility to the law firm. I’m not the subject expert here, so I’m just wondering whose responsibility is it to advise us on the reimbursement matters?

As we have missed the deadline to update hdb on the termination of extension of stay, we have to go through all the trouble to speak to hdb so that iras can re-calculate the property tax based on 1 month of extension instead of 3.

Our era agent here says that she is not privy to the information. I asked her to provide the draft to me so I can send to hdb (this is the smallest help she can do here since she did not even advise anything to us on the reimbursement and related procedures), she replied me “out of goodwill, she drafted”.

I asked her if the scope of all these (reimbursement and related matters) falls under her scope as an agent or its goodwill for agent to advise, she did not reply to me.

So seeking help here in the community.. thank you!

It seems like you're in a frustrating situation where the guidance you expected from your agent wasn’t provided, especially regarding the reimbursement for the extension of stay. Let's break down the responsibilities in this context:

### 1. **Role of the Buying Agent**
- The primary responsibility of a **buying agent** is to represent you in finding and negotiating the purchase of a property. While the agent should guide you through the transaction process, their **specific duties** regarding post-purchase matters like reimbursement for extension of stay can vary.
- **Reimbursement for Extension of Stay**: In many cases, this is a **negotiable point** between the buyer and seller, and agents should inform their clients about potential costs that might arise, including whether reimbursement for extension fees is applicable.
- While it’s not necessarily a legal obligation for the agent to advise on these reimbursement details, **good practice** would be to proactively inform you about all related costs (including post-sale issues like extension of stay), especially since your agent is experienced and should be aware of these nuances.

### 2. **Responsibility for Advising on Reimbursement**
- **Agent's Responsibility**: While the agent may not be **legally required** to advise on the exact reimbursement amounts or procedures, a **responsible agent** would typically flag potential issues such as the **extension of stay** and guide the client on how to handle it, including advising on the **necessary steps for reimbursement** from the seller.
- **Law Firm's Role**: The law firm typically handles the legal paperwork and the official processes related to the completion of the sale, such as the sale and purchase agreement. However, they are **not** typically responsible for advising you on **post-completion practical matters** like reimbursements for extension of stay unless explicitly stated in the agreement.
- If your agent recommended the law firm, they should have also ensured that you were **properly guided** on all necessary actions, such as tracking costs incurred during the extension and liaising with the seller to get the reimbursement.

### 3. **Missed Deadline for HDB Notification**
- Since the extension of stay period was not terminated on time, you now have to go through the trouble of contacting HDB to rectify the issue with the property tax. Ideally, your agent should have **reminded you** to inform HDB about the termination of the extension or at least advised you that this step was crucial.
- The fact that you missed the deadline suggests a lack of **communication or follow-through** from the agent’s side, which should have been part of their role in ensuring a smooth transition after the purchase was completed.

### 4. **Goodwill vs. Professional Obligation**
- It seems like the agent is making it clear that any extra assistance (such as drafting the letter to HDB) is out of "goodwill" rather than a professional obligation. While it’s **not strictly her responsibility** to handle these post-purchase issues, a **responsible agent** should have provided **clear advice** on what steps to take, including the possibility of needing to engage with HDB or handle reimbursements.
- This situation reflects poor communication and lack of proactive guidance from an experienced agent, which could be seen as a failure in the agent’s service.

### 5. **What Should Have Happened**
- Ideally, the buying agent should have:
- **Informed you about the extension of stay** costs and potential reimbursements upfront.
- **Advised you to keep track of these costs** and facilitated communication with the seller’s agent or law firm to ensure the reimbursement process was clear and timely.
- **Guided you through the HDB notification process** if any action was required, such as termination of the extension.

### 6. **Next Steps**
- Since you’ve already contacted your agent, but have not receiv Read More

I wouldn't really say these are things that agents need to do, but these should be something that agent can provide to value add the process of transacting a property, given that these are things consumers may not have experience in dealing with.

Sometimes, it is a case of I don't know what I don't know to ask the relevant questions. I'll suggest you speak to the law firm to seek advise on what you can do to claim against the agent if that is your intention, or put in a formal complain into CEA to investigate if there is any misrepresentation on the agent's part.
