Hi, my property's title deed is under a joint tenancy and my husband just passed away recently, so I became the sole survivor. As the place is rather big for my shrinking family, my family and I feel that we want to change to a smaller unit, hence I need to sell this unit. However the title deed is still in both me and my husband's name. Since I am the sole survivor in a joint tenancy:

1)Do I need to change the title deed to my name first before I can sell my property?
2)Can I sell it without changing the title deed to my name?

Hi Lai Wah,

I am sorry to learn that your husband just passed away, my deepest condolence to you.

Since it is under joint tenancy, once your husband passed away, the property will automatically belong to you. There is no need to change your title deed when you want to sell off your property.
