1) In all property-related matters, all parties; buyer and seller have to agree free of duress.
2) In other words it is a willing buyer and a willing seller.
3) If you wish to lock down the current agreement/promise following are some of the terms that should be specifically stated:
(a) Timing of transaction, exact date, and time.
(b) You must be the only buyer if they are willing to sell with vacant possession at a later date.
(c) A penalty when they break on their promise.
(d) A consideration (money) to serve as a deposit of the purchase. Make sure you hold evidence to prove you had made this payment.
(e) Agreed price of selling/purchase.
(f) Make sure there are witnesses on this "interest to buy".
4) But note that the relationship might turn sour when all these terms are inserted without their willing consent.
