I am 38 Singaporean and my wife has her name under a private property which was paid by My father in law. I also have a 2 year old and I want to find out if we are eligible to buy an ec or hdb with me and my son's name?

Please help me find solution as the property is too squeeze with her family inside and we want to buy our own hdb or ec.

I’m Daniel Tan from PropNex Realty.

You will need to apply the HDB or EC with your wife. However with her having a private property under her ownership, you will not be able to do that.

A few possible solutions will be to :

1. Purchase a private property under your own name

2. To transfer the current ownership of the private property to another name, thus enabling you and your wife to buy a resale HDB; Subjected to Seller Stamp Duties and Additional Buyer Stamp Duties.

Hi Ken,

From your descriptions, there are some info missing to provide a definite answer.
(1) Your wife residence status; SC, SPR, foreigner etc.
(2) Want to buy new EC or resale.

With only yourselves and your son alone, is insufficient to form a family nucleus to buy new EC since you still have a wife.

Thus you are only eligible to buy resale HDB or resale EC.

(1) Buying resale HDB, you may purchase under Non-Citizen Spouse scheme.
(2) Buy resale EC below 10 yrs old does not have strict policy on your family nucleus, the only requirement is you must be a SC. It is considered as private for SC & SPR.
(3) To buy resale EC above 10yrs, there are totally no restrictions at all.

However, it is advisable for your wife to remove her name from the private condo to avoid ABSD upon purchasing your resale HDB or EC.

Hi,

For both hdb and new EC, you have to apply with your wife's name as well, which means she has to remove her private property ownership. I believe this is not an option you are open to. The best solution is to purchase a private property under your own name.

Hi Ken,

I understand your current situation.

You will not be able to apply for a new BTO flat or a brand new EC, as you wife currently owns a private property.

If you were to purchase a resale HDB flat, you will have to include your wife's name. Which means, she will have to remove her name from the private property within 6 months upon the approval of the HDB purchase.

Alternatively, if finances allows, you may consider purchasing a private condo under your sole name. There will be no restrictions in this case.
