I engaged a property agent to rent out a property who promised to manage the property on my parents behalf while they are overseas for 2 years, however after she got her commission she said her duty is only to rent out the property. What can we do ?

Hi, I am sorry to hear this, but this depends on the agreement made with the agent. If there is a written agreement between your parents and the agent, then the agent conducted a breach of duty, and you can report the agent. Usually as long as the agents agree to such arrangements, they will follow along.

By the way, yes sadly that is true and according to the CEA, the landlord’s agent duty is deemed completed the moment the unit has been handover to the tenant. But most agents including myself will choose to continue serving/ assisting the landlord as a form of goodwill. Anyway, you could also feel free to contact me should you have any issue with the tenant for the next 1 to 2 years and I would be glad to give you advice for free :)

Are you the power of attorney to act on behalf of your parents for this rental and are you based in Singapore? Am unsure if the service agreement signed with the agent includes the management portion, as most agents will unlikely want to be involved in managing the tenancy by obligations. Am unsure how long more does the tenancy have to run out and what are the issues you are facing now for the rental. There could be various ways to manage this.

The agent is not wrong to state that her duty ends when the unit is being rented out. For property management, it is usually a value added service that is provided by the salesperson. Some salesperson offer the service as a free of charge complimentary service whereas others charge a fee for it.
