I have a private property and my wife has a joint name private properties with me . We intend to sell the joint name property and purchase a HDB flat . The HdB flat will be under my wife name while I be the occupier . Can this arrange be done for purchase a HDB either resale of BTO

Hi there, this is actually a multi-part question.
Current situation. you are holding two properties, one of which with your wife as joint owner. You are thinking of selling the jointed property and apply for a HDB with your wife as owner as you as essential occupier.

First, in order to purchase a HDB, both owners and essential occupier must not own any other forms of residential properties. And also wait out an additional 15 months after the sales of their current properties before they can sell an HDB.
Second, it is possible to buy a HDB with only your wife as owner as you as essential occuiper. But take noted that the MOP of 5 years is applicable to both parties before they are allow to purchase another properties.

1. After selling your current private property, you will need to wait 15 months for BUYING resale HDB without HDB LOAN / GRANTS , 30 months if it is BTO,
2. You can buy the HDB with your wife as the sole owner, and you as the essential occupier.
3. However, both of you will be subject to the Minimum Occupation Period (MOP) of 5 years before you can purchase another property.

Hi Sir,

For this plan to be feasible, both you and wife will need to be above the age of 55 years old. As you are selling a private property, BTO is not an option as it involved a wait out period of 30 months.

If both of you are over the age of 55 years old then you may purchase a resale HDB of 4 room or smaller immediately. If either one of you are below the age of 55 years old, then there will be a wait out period of 15 months before you can buy.

As for the manner of holding, you may purchase under both names as owners or one name as owner and one name as occupier. This is fine. Please feel free to contact me privately so that I can understand your intentions and explain to you in greater details.

I assume you meant that you own 1 private property individually, plus another private property jointly with your wife. In this case, when you do a joint purchase of hdb with your wife (regardless whether you are owner or occupier), you are required to sell off all your private properties.

If you are below 55 years old, you need to sell off the private properties first, wait out 15 months, before you are eligible to purchase resale HDB. If its BTO, the waiting out period is 30 months.

HDB owner, co-owner and essential occupier must not own any private property, to be eligible for the purchase.
In your case, after selling the jointly owned property, you will still be holding onto private property. Even if you choose to sell that away, both of you will need to fulfill a 15-month wait-out period to be eligible for the purchase. Exception is applicable if both of you are above the age of 55.
